Terms of Service

The terms for using OpenPromoter Cloud and openpromoter.com. Plans, billing, your responsibilities as a program owner, payouts, data and liability.

These terms cover OpenPromoter Cloud at app.openpromoter.com and the website openpromoter.com. When you create an account, you accept them. If you sign up for a company, you accept them for that company.

DevDiggers Technologies runs OpenPromoter. "We" and "us" on this page mean DevDiggers Technologies. "You" means the person or company that holds the account.

Who we are

  • Address: 548, Sector 12D, Awas Vikas Colony, Bodla, Agra, Uttar Pradesh, India, 282007
  • Email: support@openpromoter.com

Cloud and self-hosting

OpenPromoter comes in two forms.

  • OpenPromoter Cloud is the version we host for you. These terms cover it.
  • Self-hosted OpenPromoter is the source code you run on your own server. The AGPL-3.0 license covers it. These terms do not. We give no support promise for self-hosted copies.

Your account

  • You must be 18 or older and give a real email address.
  • Keep your password private and turn on two-factor sign-in. You are responsible for what happens under your account.
  • You may invite team members. Each one must accept these terms.
  • Tell us right away at support@openpromoter.com if you see access you did not allow.

Plans and billing

The pricing page lists the current plans. Each plan covers a level of revenue your partners bring in each month.

  • Paid plans are billed monthly in US dollars through Stripe. They renew on their own until you cancel.
  • Prices do not include taxes. We add Indian GST where the law requires it.
  • If your partner revenue passes your plan's level, we tell you and ask you to upgrade. Tracking, commissions and payouts keep running.
  • You can upgrade, downgrade or cancel at any time under Settings > Billing. A cancellation takes effect at the end of the period you paid for.
  • We may change prices. We give at least 30 days of notice by email first. A change never affects a period you already paid for.
  • The Refund Policy explains when we refund a payment.

Your affiliate program

You run your own program on OpenPromoter. That means you are responsible for:

  • The terms you give your partners and the commissions you promise them
  • Paying your partners what they earn
  • Your own taxes and the tax forms your partners need
  • A privacy policy and cookie notice on your own website that cover the tracking script
  • Consent from visitors where the law in their country requires it
  • The accuracy of the data you add

OpenPromoter helps with these tasks. It does not take them over.

Payouts

OpenPromoter sends payouts through your own Stripe, PayPal or Wise account. The money moves from your account to your partners. We never hold or receive it.

We are not a bank, a payment service or a money transmitter. We charge no fee on payouts. Your payment provider may charge its own fees.

A person on your team approves every payout. Check each batch before you approve it. We are not responsible for a payout you approved.

AI features

Some features use AI to suggest commissions, find partners, write messages and answer questions. AI can be wrong. Review every suggestion before you act on it.

Acceptable use

Do not use OpenPromoter to:

  • Break any law, including spam, privacy and consumer protection laws
  • Send email to people who did not agree to get it
  • Run a scheme that pays mainly for recruiting other people
  • Promote illegal goods or services
  • Upload malware or files you have no right to share
  • Attack, probe or overload our servers or anyone else's
  • Get around plan levels or account limits by abuse

We may suspend an account that breaks these rules. We tell you why unless the law or a security risk stops us.

Your data

Your program data belongs to you. You can export it or delete your account under Settings > Account.

When we process personal data inside your program, we do it on your behalf. The Data Processing Agreement covers that. The Privacy Policy covers the data we hold about you as a customer.

We may use usage totals that name no person or company to improve the product.

Service availability

We work to keep OpenPromoter Cloud running at all times. We do not promise a set uptime. Planned maintenance happens when traffic is low, and we tell you first when we can.

Ending your account

You can delete your account at any time. We may close an account after a serious or repeated breach of these terms. We may also close an account after 60 days of unpaid invoices.

Before we close an account for any other reason, we give 30 days of notice. You can export your data in that time.

Warranty

We provide OpenPromoter Cloud "as is". As far as the law allows, we give no other promises about it. That includes fitness for a particular purpose.

Limit of liability

As far as the law allows, we are not liable for indirect or consequential losses. That includes lost profits, lost revenue and lost data.

Our total liability under these terms is capped. The cap is the amount you paid us in the 12 months before the claim.

Governing law

The laws of India govern these terms. The courts of Agra, Uttar Pradesh, India have jurisdiction over any dispute.

Changes to these terms

We may update these terms. For a big change, we email you at least 30 days before it takes effect. Using OpenPromoter Cloud after that date means you accept the new terms.
